Fogpane Privacy Policy
This policy explains how the Fogpane mobile application (the “App”) uses information and protects users' privacy. Fogpane lets users create images on a virtually misted surface, use photos as backgrounds, store creations on their device, and unlock Fogpane Pro features.
1. Data controller and contact details
The controller of data associated with use of the App is Adam Sokolnicki, the creator of the Fogpane App (the “Controller”).
For privacy-related matters, contact: fogapp@proton.me.
2. Information processed by the App
User photos and creations. After granting permission, you may select a photo from your device's library and use it as a background. The selected photo and images you create are processed locally on your device. The Controller does not receive them or upload them to its own server.
Rights to photos and creations. You retain all rights to your photos and creations. By selecting or using a photo in Fogpane, you confirm that you own it or have the necessary rights and permissions to use and process it. Fogpane processes the selected photo only to provide the features you request.
Local Fogpane gallery. Creations saved to the Fogpane gallery are stored in the App's private space on your device. You can delete them from within the App. Uninstalling the App generally also deletes data stored in its private space, subject to the operation of device-system backups.
Saving and sharing. When you save a creation to your photo library or use the system sharing feature, the file is sent to the app or service you select. Further processing is governed by that service's terms and policies.
Fogpane Pro purchases. Purchases are processed by the Apple App Store. The Controller does not receive full card details or other payment information. Apple may process account, device, payment, and purchase information in accordance with Apple's privacy policy.
Managing Fogpane Pro entitlements through RevenueCat. The App uses RevenueCat, Inc. to verify purchases, restore purchases, and determine whether Fogpane Pro features should be active. In particular, RevenueCat may receive:
- a random, anonymous App user identifier;
- information about the purchase, App Store receipt, product, price, currency, and entitlement status;
- basic technical information such as device type, operating system, App version, IP address, and time of last use.
Fogpane does not create user accounts and does not provide RevenueCat with a user's first name, last name, or email address. The Controller does not use the anonymous identifier to determine your real identity.
Contacting the Controller. If you choose to contact the Controller, the data contained in your message will be processed, such as your email address, the content of your request, and information needed to respond.
3. Purposes and legal bases
Data may be processed for the following purposes:
- providing App functionality, processing and restoring purchases, and supporting Fogpane Pro — to perform a contract or take steps at your request (Article 6(1)(b) GDPR);
- ensuring security, preventing misuse, diagnosing problems, and protecting legal claims — based on the Controller's legitimate interests (Article 6(1)(f) GDPR);
- handling questions and requests — to perform a contract or based on the legitimate interest in communicating with users (Article 6(1)(b) or (f) GDPR);
- meeting tax, accounting, and legal obligations — to comply with a legal obligation (Article 6(1)(c) GDPR).
Access to the photo library is voluntary. Refusing or withdrawing permission will prevent you from choosing a photo as a background or saving a creation to the library, but other App features may continue to work.
4. Recipients of data
To the extent necessary for the App to operate, information may be processed by:
- Apple Inc. and relevant Apple group companies — for App distribution, payments, purchases, and purchase restoration;
- RevenueCat, Inc. — for handling and verifying purchases and Fogpane Pro entitlements;
- email, hosting, or technical-support providers used by the Controller, if you contact the Controller;
- apps and services you select in the system sharing panel.
5. Transfers outside the European Economic Area
Apple and RevenueCat operate globally, so purchase-related information may be processed outside the European Economic Area, particularly in the United States. Transfers take place using mechanisms provided for by the GDPR, such as an adequacy decision or standard contractual clauses, as applicable.
6. Retention periods
- photos and creations stored locally remain on the device until you delete them or remove the App's data;
- purchase information is retained by Apple and RevenueCat for as long as needed to process the purchase, restore entitlements, prevent fraud, and meet legal obligations;
- correspondence is retained for the time needed to handle the matter and then until the applicable limitation period for claims expires;
- accounting and tax records are retained for the period required by law.
7. Your rights
Within the limits provided by law, you have the right to:
- access your data and receive a copy;
- rectify or complete your data;
- erase your data;
- restrict processing;
- data portability;
- object to processing based on legitimate interests.
To exercise these rights, write to the address listed in section 1. We may ask for information needed to locate an anonymous purchase record. Deleting data from RevenueCat does not cancel a purchase or any subscription managed by Apple. You also have the right to lodge a complaint with the President of the Polish Personal Data Protection Office: uodo.gov.pl.
8. Children
The App does not require an account and is not designed to knowingly collect children's data. App Store purchases are subject to Apple account settings, including Family Sharing and Ask to Buy features where enabled.
9. Advertising, analytics, and tracking
Fogpane contains no advertisements or third-party analytics tools and does not use data to track users across apps or websites for advertising purposes. Purchase information is used to operate Fogpane Pro, verify transactions, and provide aggregate sales analytics in RevenueCat.
10. Security
We use safeguards appropriate to the nature of the App, including local storage of creations in the App's private space and encrypted connections used by providers that process purchases. However, no method of storage or transmission can guarantee complete security.
11. Third-party services
12. Changes to this policy
This policy may be updated following changes to the App, its providers, or applicable law. The current version will be published at the same address together with its last updated date.
